The City of Cranbrook said they can not restrict the use of a property in Slaterville despite the resident’s concerns.
The city has received a number of correspondence letters from residents near a property at 824 4th Street Northwest, concerned over a recent sale of the property and the new owner’s plans for a gravel and rock business.
The main concerns are due to an increase in dust, noise and heavy machinery on local roadways.
However, city officials said the area is currently zoned M3 for heavy industrial and while they understand the concerns the city can’t interfere.
M3 zoning allows for manufacturing, extraction of sand and gravel, wholesaling of waste material, recycle depot, transportation facilities and airport among other uses.
City officials said they also can’t require the property owner to to complete road or safety improvements since the use falls into the existing zoning.
Should the property undertake any further activity that requires any permits or zoning changes it would have to go before council and public notification or hearings would occur.
